Maker’s Mark Makes Their Mark
I couldn’t resist the opportunity to mention my ol’ fave
As of April 2, the distinctive red wax seal on the top of every Maker’s Mark bottle is now again theirs to use exclusively. Although the famous Kentucky bourbon distillery trademarked the decorative seal in 1958 and has fought to defend their rights to it , various liquor companies have attempted to use the seal over the years to give their product an “artisan” look (most-recently Mexican mega tequila maker Cuervo). A federal judge issued an injunction against Cuervo, ending a seven year legal battle and putting Maker’s Mark back in control of their, as the judge put it, “inherently distinctive and unique mark”.
I’m all for a good tequila, as well as some fair competition, but it’s great to see the little guy win sometimes. Originality and consistency hold their ground!
